Note Regarding Reservoir: There is an open pending court case (Case No. 16CW-CV00342) in the Court of Callaway County. This case relates to the maintenance of the dam for the reservoir. Prior to 2007 the dam had an agricultural exemption which made it exempt from the maintenance requirements of the Department of Natural Resources. Solutions are 1) the trees and brush on the dam need to be cleared and maintained on an ongoing basis, 2) the lake level lowered by about 7 feet to be under 35 feet – then the dam will be exempt from the states maintenance requirements, or 3) the lake is drained. A consensus needs to be reached among the 11 properties that border the lake and dam as to what they would like to do. Lot 29 is not part of the court case as it does not border the lake and dam.
